§ 102-76. Disposal of cut and stored elm wood.

  • (a)

    If the director or commissioner shall, during the inspections made pursuant to this division, discover elm wood that has been cut, or cut and stored, which is infected or may be infected by Dutch elm disease fungus, the director or commissioner may, in order to prevent the storage, movement or sale of such elm wood and thereby the spread of the fungus causing Dutch elm disease, act to cause the disposal of the wood in as expeditious manner as practical.

    (b)

    For purposes of this section, other sections contained in this division commencing with section 102-65 through and including section 102-75 are not applicable, as the procedural delay that may occur may cause eminent spreading of the fungus to other trees within the vicinity.
