§ 46-2. Penalty.
(a)
Notwithstanding section 1-21, a violation of any of the sections of this Code which are derived from provisions of title 6 of the Sacramento County Code or failure to comply with any of the regulatory requirements of such title 6 provisions is an infraction subject to the procedures described in Penal Code §§ 19.6 and 19.8.
(b)
Any person, whether as principal or agent, employer or employee, who violates any of the sections of this Code which are derived from provisions of title 6 of the Sacramento County Code or the rules and regulations of the health officer established pursuant to such title 6 provisions is, upon conviction, guilty of an infraction.
(c)
Every violation of any of the sections of this Code which are derived from provisions of title 6 of the Sacramento County Code is punishable by:
(1)
A fine not exceeding $50.00 for a first violation.
(2)
A fine not exceeding $100.00 for a second violation of the same section within one year.
(3)
A fine not exceeding $250.00 for each additional violation of the section within one year.
