§ 78-54. Exemptions.

(a)

Financial institutions and ATMs. The prohibition related to financial institutions and ATMs set forth in subsection 78-52(4) shall not apply to any automated teller machine located within any building, structure or space whose primary purpose or function is unrelated to banking activities, including, but not limited to, supermarkets, provided that such automated teller machine shall be available for use only during the regular house of operation of the building, structure or space in which the machine is located.

(b)

Gasoline stations and fuel pumps. The prohibition related to gasoline stations and fuel pumps set forth in subsection 78-52(), shall not apply to any of the following:

(1)

To solicitations related to business which is being conducted on the premises by the property owner, business owner, or employees of the business;

(2)

To solicitations related to the lawful towing of a vehicle; or

(3)

To solicitations related to emergency repairs requested by the operator or other occupant of a vehicle.
