§ 94-138. Driving near when siren sounds.

  • It is unlawful for any person operating any vehicle upon the public highways or any private road or driveway to operate or drive any vehicle in the same direction that any authorized emergency vehicle is traveling while the emergency vehicle is giving audible signal by siren, and has at least one lighted lamp exhibiting a red light visible under normal atmospheric conditions, from a distance of 500 feet to the front of such vehicle, until such authorized emergency vehicle shall be at least 500 feet distant. It is unlawful for any person to operate or drive any vehicle so as to approach within 500 feet of such authorized emergency vehicle, giving audible signal by siren and having at least one lighted lamp exhibiting a red light visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle.
