§ 98-53. Acts prohibited.

  • (a)

    It shall be unlawful for any person to construct, modify, repair, inactivate, or destroy any well or to install, repair, or replace any well pump unless such person has:

    (1)

    Obtained a permit issued from the enforcement agency for the specific work to be performed; or

    (2)

    In an emergency, fully complied with the sections of this division relating to emergencies.

    (b)

    It shall be unlawful for any person to construct, modify, repair, inactivate, or destroy any well or to install, repair, or replace any well pump unless such action is in accordance with the standards set forth in this division.

    (c)

    It shall be unlawful for the property owner to allow a nuisance or an abandoned well to exist on the property.

    (d)

    It shall be unlawful for any person to willfully or intentionally submit any false statement, record, or data in connection with a permit application to construct, modify, repair, inactivate, or destroy a well or to repair or replace any well pump.
