This division shall be applicable to new and rehabilitated landscaping for industrial,
commercial, and institutional developments; to parks and other public recreational
areas; to multifamily residential, common areas and model homes; and city road medians
and corridors; all as defined in the city's zoning code. However, this division shall
not be applicable to the residential portions of developments which are subject to
a development agreement entered into pursuant to Government Code §§ 65864—65869.5
if such development agreement was in effect as of January 1, 1989.
