§ 74-169. Lien.

  • (a)

    Each customer service charge for residential refuse collection service provided to a parcel located within the city, as described in section 74-40, and provided by the residential refuse collector, together with any penalties levied on any such charges pursuant to resolution or ordinance adopted by the council or rules filed by the department pursuant to section 74-2 of this chapter, is made a lien upon any such parcel receiving such refuse collection services, and any proceedings authorized by law to enforce payment of such liens may be taken by the city to enforce payment of such charges and penalties.

    (b)

    For five-acre and larger parcels wherein the owner has voluntarily subscribed to refuse collection service, the parcel shall be lienable under this section.
